this is annoying
the files or folders in question are not open in another program, windows is just refusing to let them be moved or deleted due a recent action ie: photographs moved elsewhere etc

This may also be helpful:
Open Windows explorer.
Click ‘Organize -> Folder and search options’ (or ‘View -> Folder options’).
Select the ‘View’-tab.
In the ‘Advanced settings’ window, disable ‘Launch folder windows in a separate process’.
You may need to force restart all explorer instances (via task manager) or reboot your computer if the setting is not applied immediately.
Doesn't work. It is already disabled.

Here here! I am totally sick of Windows. XP was good, since then it has been absolute ****. Ive now moved my home "non work" computer over to Apple. If anyone has a solution to this problem that works PLEASE PLEASE put it out there. Totally sick of Windows 8
This absolutely should not work but here's what I just tried and it worked. Select the files to be deleted. Delete them. When the error message pops up click "Try Again" 6 times. They go away.
It turns out it was not the clicking but the waiting. The AcroRd.exe process is active when you want to view a document. Once it goes off you can delete the document. It takes about 10 seconds for AcroRd.exe to exit.
