I am having a problem where the exclamation point is showing up and I can't get it to go away. I've tried disabling and reenabling and searching for driver updates online, etc. I am running windows 10 tech preview, which may not help much. I had this problem in 8.1 as well.

No joy with the first tablet I've tried.  It was a replacement one that was sent after I opened a case with MS.

The Touch Controller Firmware version is the same, so it doesn't look like it was updated with this release.  :(

We have some i7 versions of the Surface that haven't exhibited this issue...only the i5's.  Is that anyone else's experience or just our luck of the draw?

I am still able to access this link and it hasn't been updated since Dec 25th:

    http://support.microsoft.com/kb/3024327

Here is a link describing the 1/15/15 update:

    http://www.microsoft.com/surface/en-us/support/install-update-activate/pro-3-update-history

I don't see anything specific about this firmware update problem, but hopefully it does fix it, please keep us updated.

Looks like they've released a patch dated 1/15/2015 and removed the KB article about the code 10 or 14 error!  Trying it now to see if that resolves the issue.
