I have the same issue with the touch firmware and it's the 2nd replacement that MS sent to me to resolve this issue with Missing Surface Pro Touch Controller Firmware. Where did you get the info about the fact that battery has to be 100% charged?

    Thanks

solved, at least for me. after 3 restores, and repeated attempts of reinstalling the drive it seems to work. after reading another thread on this issue, the firmware wont take unless the battery is at 100% (99% and charging is not good enough). im keeping my fingers crossed, but no more yellow triangle. if it suddenly comes back, I might try to see how far I can Frisbee it.

I'm finding that missing driver is causing things to not be able to be installed. first noticed when I plugged in the surface keyboard that the unit didn't recognize it. then restored unit with keyboard attached, and it works fine, its that first update with the firmware upgrade causes the unit not to be able to install additional items correctly. I have a customer who I'm sure is going to return this if MS doesn't put out a new update quick.

Actually I've spoken with Microsoft representatives on 3 different occasions trying to fix the issue. In the 3rd support talk I was instructed to send the device to Microsoft and they would send a replacement. Glad the issue is being addressed but it has me very skeptical of the product now.
