I did the online chat through Microsoft Support and they went through and approved my replacement (currently on my 3rd replacement). However, I received an email yesterday (see below where I copied and pasted) from MS that they are now aware of the issue
and are working on the solution:
"My name is James with the Surface Customer Care Advocacy Team. First and foremost, we would like to thank you for taking the time to contact us regarding your Surface Touch Controller Firmware issue. I sincerely apologize for any inconveniences that this may have caused you and for the delay in contacting you.
We are currently working on a resolution for this issue which should be rolled out in a future update. I'm terribly sorry for any inconvenience. If this issue is causing issues with the functionality of your device, you can try setting up another replacement order as the issue only appears to affect some Surface devices but not all. Please let me know what you decide."
It is certainly a frustrating and disappointing experience for me as well. I'm just hoping they come out with the "fix" soon!! Luckily my device works as it should (as far as I can tell), I just hate that we've paid this much for a product and there are still
issues.
