This is absolute not acceptable, we spent so much time trying to figure it out what is the cause of this problem and many other issues, why do we have to do this, we paid for a device that works, we did not pay to be on the game of testing or experimenting.

I have not seen Microsoft knowledge what we going through, we should demand a full refund for something that does not work!.

If you feel strongly enough to file suit you're probably better off asking to return the unit for a refund. With a lawsuit you're going to be stuck with something you're not satisfied with for a very long time, and then probably get no more than a refund anyway.

Wrong.  I am stuck with it ANYWAY.  So filing suit makes sense.  Perhaps that might be a wakeup call to MS.  Certainly it's bad publicity for MS and apparently, taking 3+ months to fix issues and taking productive time away from professionals isn't a priority. 

I was left with my ____ in my hand during a presentation and sales call due to the failure of the machine to work as advertised.  Freezes up when taking notes.  I cannot even use it in clipboard mode, so why would I want this machine to begin with?  I could just a different Windows machine with all the bells and whistles that won't FAIL.

You missed or miss the entire point of a lawsuit.  And I am not one to advocate for things like that.  Many are frivolous.  This would not be.

This magnet thing might have legs. My SB always drains when powered off. The last wo nights the lid has been left open and I had no power loss in my batteries. I am going to experiment a little more and will post again.

So I was on another site reading about another user experience and discovered something that seemed impossible.

Apparently, this user said you can actually detach the screen when the SB is in full power down mode.  Completed shut down and attempted and guess what?  User is CORRECT.

Now, maybe I am late to the party with discovering that, but given that knowledge, it would seem this might be one of the bigger reasons we are seeing significant battery drain when fully powered off. 

As previous user said, "significant design flaw" seems to be appropriate wording.  How else can you detach the screen when it has no power?

Not wrong, it's an opinion, and never said the lawsuit would not have merit. It was a practical suggestion that you may be better off returning it, if possible, and move on.
