Sounds like its the graphics card driver causing the issue. This isn't the expected behavior in windows. Graphics cards and shell programs can cause this issue.

every time I copy or paste & the dialog needs me to answer an overwrite, etc... the focus of the window doesn't come to the foreground of all the open windows.
VERY annoying.

2014-04-16T17:31:11+00:00 from what I have gleaned from the great and powerful MS is that this is by design (mimic OSX a bit) and it really won't change. I have had the dialog pop to the front on rare instances of a copy/paste/move but it seems to do it on its own terms.

2014-04-15T22:36:52+00:00 I'm also facing this issue. It's so annoying, however, I noticed that it only happened to me after I installed some drivers.
I performed a clean install of Windows 8.1 and sometime when I was installing my system drivers, this exact problem returned (it was happening before). I know this because I recall moving files around after finishing the Windows setup and the copy/paste window worked as it is supposed to, and it started to go behind the other windows after installing something (I don't know for sure, since I installed Nvidia's drivers, Asus ATK and the Chipset).
Does anybody know any possible work-around for this issue?

Navigate to Control Panel\All Control Panel Items\Ease of Access Center\Make the mouse easier to useand uncheck "Activate a window by hovering over it with the mouse" Click OK.

2014-02-05T15:49:54+00:00 it's a dumb design and it copies the "bouncy" effect from OS X. The dialog window should focus on top so I can answer the question(s) and get the process moving forward. I shouldn't have to look around, click and click some more to make the copy/paste/overwrite continue.
sometimes we think we are progressing when the opposite is in fact the truth.
guess I'll wait for win 9 or for something better to come along.
