this is annoying
the files or folders in question are not open in another program, windows is just refusing to let them be moved or deleted due a recent action ie: photographs moved elsewhere etc

This may also be helpful:
Open Windows explorer.
Click ‘Organize -> Folder and search options’ (or ‘View -> Folder options’).
Select the ‘View’-tab.
In the ‘Advanced settings’ window, disable ‘Launch folder windows in a separate process’.
You may need to force restart all explorer instances (via task manager) or reboot your computer if the setting is not applied immediately.
This does not fix the problem. I never use the preview pane and still have problems. The only thing works is closing and reopening the window that has he file you want to move.
That is correct, I also have never used the preview pane.
Mostly what I experience is trying to delete a folder that has a file inside it, I can open the folder and delete the file and then delete the folder with no problems.

In windows 8 in the view toolbar Press the Preview pane to turn preview pane off.
This opens a preview of the file which locks it from being deleted.
Like with so many others on this thread, this problem has frustrated me for years. Now that I know that this is the reason, the problem is completely dealt with! Simple solution to a frustrating problem!1 Thank you!
what would be nice is if the error message gives the suggestion of turning the preview pane off. then the average person will just do it there. unfortunately, closing the preview pane doesn't always fix the issue. what would be nice is if windows had a pop up or something that says which program is using the file so that the user would know which program needs to be opened in order to close out the file. better yet, it would be nice for a pop up to say "the following program (s) using the file are XXXX, click here to release this file" or something like that. i'm pretty sure that isn't an impossible thing to develop...
