Commercial use of images generated using Copilot, Bing AI and "Image Creator from Designer"

As noted in other questions on this topic, the terms of use for Microsoft services capable of AI image generation appear to have changed in late 2023/early 2024 from a clear "non-commercial use only" policy to an ambiguous "Microsoft does not claim ownership of creations" one, with no mention of how those creations can be legally used.

Can an advisor please clarify the current (end of Jan 2024) restrictions on use of AI-generated images from Microsoft services such as Copilot, Bing AI and "Image Creator from Designer", as well as any requirements for attribution/watermarks to enable unrestricted commercial use?

    It appears the Designer 'Terms of Use' also says it is essentially it is up to you to verify you are not copying someone else's work. You can do this by running your images through online image copy checking tools, as described in my previous post.

    "Microsoft expressly disclaims any and all representations or warranties, express or implied, that any Creations (including Your generated Creations) do not infringe or otherwise violate the intellectual property rights of any third party.

    Microsoft strongly recommends consulting legal counsel regarding any use You intend to make of the Creations.

    You will indemnify, defend, and hold Microsoft harmless from and against any and all costs, expenses, and losses (including, without limitation, settlement costs and payments, attorneys’ fees, liabilities, claims, obligations, judgments, fines, and damages) incurred through claims, alleged claims, or threatened claims that Your generated Creations infringe or otherwise violate the intellectual property rights of any third party."

    Why doesnt Bing make this easier? Most creators do want to give credit when they know how. When you create an image on BING, just say underneath what we should do and what license it has please.

    The initial Terms of use stated that you can't you the images or creations for commercial use.

    The latest terms of use removed that clause.

    To summarize, although I am not a lawyer but I think there is no issue in using the creations for commercial purposes.

    Stacy, there is NOTHING in the terms for MS Designer about watermarks, that is INVENTED by Chavi.
