I ended up contacting support directly and they told me that the pen was defective. I am still awaiting my replacement pen...FYI
Surface Pro 4 Pen needs to be re-bluetooth paired after waking up/turning on surface
Hello,
My surface pro 4 pen needs to be re-paired via bluetooth after the computer has been sleeping/hibernating in order for the eraser button to function when clicked. It still shows up as a connected device in the bluetooth settings, and still writes properly even when the eraser button does not work. After removing the pen from the list of connected devices and re-pairing, everything seems to work properly but this is obviously inconvenient. Thanks for any help you can offer!

2016-11-03T17:10:14+00:00 Thanks. I have tried all you said and steps in the troubleshooter. The hibernation still destroy things and having to restart the device. It is repeatable, every single time. This is troublesome.

2016-11-02T09:10:43+00:00 Hello,
Thank you for getting back to us. Were you able to install current update? How about updating the pen driver manually via Device Manager? Was there any difference?
If the Surface Pen still unable to maintain connection with your Surface, you can check this link to troubleshoot the said pen.
Hope this helps.

2016-10-31T17:51:07+00:00 I have noticed this same thing as well. This seems to only be a temporary fix since I believe it just causes the pen to automatically re-pair. It stops working after the next hibernate though.
