Notice cancelation dial stops working on surface headphones 2

The nice cancelation dial on my surface headphones 2 stops working after a while.

And most of the times starts working again if I do a factory reset of the headphones and re-pair with my phone. But some times it doesn't help. Then a a couple of days later it will work again.

I have updates the headphones but still the problem persists. They are still under warranty but is there eneything I can do to fix this problem?
