Surface Headphones 2 Audio Stuttering / Choppy when changing devices / Noise cancelling

When I change devices the audio stutters and gets choppy if I have not paused the devices I am switching from or if I am using my PC and scrolling through my phone or playing games. I am expecting the headphones to only play smooth audio from the most recently played device, and mute the other one. This isn't what happens. It will seemingly randomly select a device to play audio from ( if i open a game on my phone or I open Instagram for example) and that audio will be choppy and extremely annoying

On top of this, it consistently takes around 7 seconds from my PC to phone but much quicker the other way around.

And on top of this, they have been randomly disconnecting from devices and going into pairing mode.

I have tried factory resets, many many times, I've been having so many issues especially when trying to pair with my surface pro 4, a MICROSOFT DEVICE THAT DOESNT EVEN WORK WITH THEIR HEADPHONES, it makes the app malfunction, I've settled with not being able to pair to it though but I can't settle on the other things.

I'm not sure if the noise cancelling is also working well or not. My £80 earbuds cancel out more noise than the surface headphones. I am unsure whether these headphones just have shockingly bad noise-cancelling or my unit is just fault because I have no reference for noise-cancelling headphones apart from the sony XM4s which most people say are better and from my experience, I would agree but the difference is much more than I would expect.

    If I am unhappy with the replacement will I be eligible for a refund?

    Please see Returning items you bought from Microsoft Store for exchange or refund to know how to check your eligibility. If you purchased it from a third-party, you may need to contact them and be within the third-party retailers return period for exchange.

    They are up to date. I have checked with some other users, some have experienced this and others haven't. Can I request a replacement online or does this have to be booked on the phone?
